The Iowa Supreme Court ruled today that the ban on same-sex marriage is unconstitutional. The only recourse at this point is for the Legislature to bring a referendum to the voters. My problem with that is if a law is said to be unconstitutional, how can the people vote against that? But for now, I'm happy for my friends who will benefit from this ruling.
The outcome of the Proposition 8 issue in California is appalling. The California Supreme Court repealed the ban on Gay Marriage in May of this year giving gay couples the right to marry. It took only 6 months for the zealots and bigots to successfully have that overturned. It's a sad day.
My opinion is that it shouldn't matter whether a couple is gay , they should have the same rights as heterosexual couples. We have evolved and science now recognizes that hoosexuality is not a choice or a moral failing. A loving relationship should be celebrated. Period.
I don't buy the argument that giving gays the right to marry would undermine the institution of marriage. We straight people ain't doing so well on that front with 50% of first and 75% of second marriages going down the toilet.
And that brings up another point. Who has the right to define what marriage is? Who makes the laws in this country? Churches have the right to make whatever rules they decide are best for their members, but those rules should not be incorporated into state statutes. In my very humble opinion, there should be a distinction between marriage in the eyes of church and in the eyes of the law. States should sanction gay marriage with all the rights and privileges of hetero marriages (including who decides to take out the trash and who wakes up at midnight to feed the baby. The baby thing is another subject I'll get into later). Churches should be left alone to either recognize or ban those unions within the bounds of their doctrine.
The bottom line is that I celebrate love and the committment couples make to seal that union. It's none of my business what they do in their bedrooms.
